Officials order halt to unauthorised excavation in Baan Phru Champa
Thepkrasattri officials suspended excavation work in Baan Phru Champa after finding three pits had been dug without approval under the Land Excavation and Filling Act.
Officials in Thepkrasattri have ordered all excavation work at a site in Baan Phru Champa to stop after finding three large pits had been dug without authorisation.
The inspection was carried out on Monday, July 6, after Thepkrasattri OrBorTor received reports of ongoing excavation in Soi Hin Lat, Moo 3, Baan Phru Champa. OrBorTor Chief Sittichai Chanthawat assigned planning and construction officials led by Ariya Khwanlek to inspect the site.
Officials said Thai Naprasert Mining Co Ltd had excavated three pits at the location. Pit 1 measured 100 by 200 metres and was about four metres deep. Pit 2 measured 150 by 300 metres and was about four metres deep. Pit 3 measured 30 by 200 metres and was about four metres deep.
According to the OrBorTor, the excavation had not been authorised under the Land Excavation and Filling Act B.E. 2543 (2000). Officials erected a suspension notice at the site and issued an order requiring all excavation work to stop immediately until the operation complies with the law.
Mr Sittichai said the company had told officials the pits were intended to be used as small reservoirs to supply water to local residents and businesses. He said the company was not permitted to clear land or dig any part of the site without approval, and that the halt order remained in effect.
The OrBorTor also advised the company to verify land boundaries and carry out a proper land survey before applying for any future permits to avoid disputes and reduce impacts on nearby communities.
Under the Land Excavation and Filling Act, excavation deeper than three metres, excavation covering more than 10,000 square metres, or work that could pose a risk to people or property requires prior notification or approval from local authorities. Violations are punishable by up to one year in prison, a fine of up to B50,000, or both.
A follow-up inspection involving the Phuket Land Office, Thalang Police, the Phuket office of the Ministry of Natural Resources and Environment and Thepkrasattri OrBorTor is scheduled for July 20.
